Acceptance of Terms
By accessing or using The Paddock platform ("Platform," "Service") operated by Triple Crown Investments ("Company," "we," "us," or "our"), you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Platform.
These Terms apply to all visitors, users, subscribers, and others who access or use the Service. By creating an account, initiating a free trial, or paying for a subscription, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Platform Description
The Paddock is a software-as-a-service (SaaS) platform that provides real estate acquisition professionals with tools including but not limited to:
- AI-powered distressed property lead scoring and analysis
- Property data retrieval via third-party APIs (BatchData)
- Owner contact information lookup ("skip tracing") via BatchData's Property Skip Trace service
- AI-generated outreach message drafting via Anthropic's Claude API
- SMS and email communication tools via Twilio and Resend
- Street-level property imagery and visual distress analysis
- Pipeline and lead management tools
- Team management and collaboration features
The Platform acts as an interface to various third-party data and communication services. We do not guarantee the accuracy, completeness, or timeliness of any data retrieved through third-party integrations.
Accounts & Access
Registration: You must register for an account to access the Platform. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
Approval: All new accounts are subject to review and approval by Triple Crown Investments. We reserve the right to approve or reject any registration at our sole discretion.
Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at coleton@triplecrowninvestments.com of any unauthorized use of your account.
Team Members: Subscribers on Pro and Agency plans may invite additional team members. Each team member must comply with these Terms. The account holder is responsible for all actions taken by invited team members.
One Account Per User: Each individual may maintain only one account. Creating multiple accounts to circumvent restrictions or trial limitations is prohibited and may result in immediate termination.
Subscriptions & Billing
Plans: The Platform is offered on a subscription basis with the following plans:
- Starter: $147/month + $197 onboarding fee — 1 seat
- Pro: $247/month + $297 onboarding fee — up to 3 seats
- Agency: $497/month + $497 onboarding fee — up to 10 seats
Billing: Subscriptions are billed monthly in advance via Stripe. By providing payment information, you authorize us to charge the applicable subscription fee on a recurring monthly basis.
Onboarding Fee: A one-time onboarding fee is charged at the time of initial subscription and is non-refundable.
Usage-Based Costs: Certain features incur additional costs based on usage, including skip traces ($0.07 per successful match charged to your BatchData account) and outbound SMS messages (charged at Twilio rates). These costs are billed directly by the respective third-party providers and are not included in your subscription fee.
Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.
Refunds: Except as required by applicable law, subscription fees are non-refundable. Onboarding fees are non-refundable under all circumstances.
Price Changes: We reserve the right to modify subscription pricing with 30 days' written notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
Acceptable Use Policy
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Platform to engage in any activity that violates federal, state, or local laws or regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and Fair Debt Collection Practices Act
- Send unsolicited communications (spam) to individuals who have not consented to receive them
- Harass, threaten, intimidate, or engage in predatory practices toward property owners
- Use skip trace data to stalk, harass, or harm any individual
- Attempt to circumvent any Platform security measures or access controls
- Reverse engineer, decompile, or attempt to extract the source code of the Platform
- Resell, sublicense, or commercially redistribute Platform access without written authorization
- Use automated bots or scripts to access the Platform in ways that exceed normal usage patterns
- Input false or misleading information into the Platform
- Use the Platform for any purpose other than legitimate real estate investment and acquisition activities
Communications & Outreach Features
Your Responsibility: The Paddock provides AI-drafted message suggestions and delivery infrastructure for SMS and email outreach. You are solely responsible for reviewing all messages before sending and for ensuring all communications comply with applicable law.
TCPA Compliance: Before sending any SMS message to a property owner, you must ensure you have a lawful basis to do so under the TCPA. The Platform's skip trace feature notes TCPA-blacklisted phone numbers via BatchData's includeTCPABlacklistedPhones flag, but you bear ultimate responsibility for compliance.
Do Not Call Registry: You are responsible for honoring Do Not Call (DNC) registrations where applicable to your outreach activities.
AI-Generated Content: Messages generated by the Platform's AI tools are suggestions only. You must review, edit, and approve all AI-generated content before sending. Triple Crown Investments is not responsible for the content of messages you send.
Third-Party Delivery: SMS delivery is provided by Twilio, Inc. Email delivery is provided by Resend, Inc. The Company is not responsible for delivery failures, delays, or errors by these third-party providers.
Data & Third-Party APIs
Property Data: Property information displayed on the Platform is sourced from BatchData and other third-party providers. We make no representation that such data is accurate, current, or complete. You should independently verify all property data before making any investment or business decision.
Skip Trace Data: Owner contact information retrieved through skip tracing is provided by BatchData. Such data is subject to BatchData's own terms of service and data licensing agreements. By using the skip trace feature, you agree to use retrieved contact information only for lawful real estate investment purposes.
Data Accuracy: The Company does not warrant the accuracy, completeness, reliability, or timeliness of any data provided through the Platform. Real estate data changes frequently, and information displayed may not reflect current conditions.
Your Data: You retain ownership of all lead data, notes, and communications you create within the Platform. See our Privacy Policy for details on how we collect, store, and use your data.
Third-Party Terms: Use of certain Platform features is also governed by the terms of service of our third-party providers, including:
- BatchData (batchdata.com) — property data and skip tracing
- Anthropic (anthropic.com) — AI message generation
- Twilio (twilio.com) — SMS delivery
- Resend (resend.com) — email delivery
- Stripe (stripe.com) — payment processing
- Google (google.com) — maps and street view imagery
Intellectual Property
Platform Ownership: The Platform, including its design, code, algorithms, scoring models, AI prompts, workflows, branding, and all associated intellectual property, is owned exclusively by Triple Crown Investments. These Terms do not grant you any ownership interest in the Platform.
License to Use: Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal real estate investment business purposes during the subscription term.
Restrictions: You may not copy, modify, distribute, sell, or lease any part of the Platform, or attempt to reverse engineer or extract the underlying technology.
Your Content: You retain all rights to content you create within the Platform (leads, notes, messages, etc.). By using the Platform, you grant us a limited license to store and process your content solely to provide the Service.
Feedback: Any suggestions, ideas, or feedback you provide about the Platform may be used by us without restriction or compensation to you.
Disclaimers & No Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TRIPLE CROWN INVESTMENTS DISCLAIMS ALL WARRANTIES, INCLUDING:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Platform will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, completeness, or reliability of any data, AI-generated content, or property analysis
- Warranties that skip trace results are accurate, lawfully obtained, or current
- Warranties that use of the Platform will result in successful real estate transactions
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIPLE CROWN INVESTMENTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from reliance on AI-generated content, property scores, or data provided through the Platform
- TCPA or other regulatory violations arising from your use of outreach features
- Third-party service failures (BatchData, Twilio, Resend, Stripe, etc.)
- Any amount exceeding the total subscription fees you paid in the three (3) months preceding the claim
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
Termination
By You: You may terminate your account at any time by canceling your subscription and ceasing use of the Platform. No refund will be issued for the remaining subscription period.
By Us: We may suspend or terminate your account immediately, without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, failed to pay applicable fees, or if continued provision of the Service creates legal or regulatory risk for the Company.
Effect of Termination: Upon termination, your right to access the Platform immediately ceases. You remain responsible for all charges incurred prior to termination. Data stored in your account may be deleted after 30 days following termination.
Survival: Sections 7 (Data), 8 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), and 12 (Governing Law) survive termination.
Governing Law & Dispute Resolution
Governing Law: These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles.
Informal Resolution: Before initiating any formal dispute, you agree to contact us at coleton@triplecrowninvestments.com and attempt to resolve the matter informally for at least 30 days.
Arbitration: Any dispute not resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration shall take place in North Carolina. You waive any right to a jury trial.
Class Action Waiver: You agree that any dispute will be resolved individually and not as part of a class or collective action.
Exceptions: Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify active subscribers of material changes via email at least 14 days before the changes take effect. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
We encourage you to review these Terms periodically. The "Last Updated" date at the top of this page indicates when changes were last made.
